Terms and Conditions

Welcome to thankyouteacher.my (TQT) Website/Apps. If you continue to browse and use this Website/Apps via the web, you are agreeing to comply with and be bound by the following terms and conditions of use, which govern our relationship with you in relation to this Website/Apps. If you disagree with any part of these terms and conditions, please do not use our Website/Apps.

Definitions

  1. The term ‘MSEF’ or ‘us’ or ‘we’ or ‘the foundation’ refers to MALAYSIAN SOCIAL ENTREPRENEURS FOUNDATION (Company No.: 1160621-T), a company incorporated in Malaysia.
  2. The term ‘TQT Teacher Appreciation Programme’ or ‘thankyouteacher.my’ or ‘TQT’ or ‘TQT Website/Apps’ refers to this web that owns by MSEF.
  3. The term ‘Long Service Gratuity’ or ‘LSG’ refers to this web that owns by MSEF.
  4. The term ‘Applicants’ refers to individuals who are either current or retired Chinese independent school teachers or staff who have reached the age of 65 or older by January 1 of the issuance year, and are registered with the TQT Website/App to apply for the Long Service Gratuity.
  5. The term ‘you’ and ‘your’ refers to the user or the general visitor of our TQT Website/Apps, where applicable.
  6. The term ‘Bank Account’ refers to Applicant’s personal bank account with their respective bank. Requests for transfers to accounts belonging to friends, relatives, school or joint bank accounts will not be permitted.
  7. The term ‘Personal phone number’ refers to the Applicant’s personal phone number, used for verification via an OTP code sent by SMS for registration or log in this TQT Website / Apps.
  8. The term ‘Verification’ refers to the process conducted by a representative authorised by MSEF or the Chinese independent school where the applicants have served for the purpose of verification.

The use of this TQT Website/Apps is subject to the following terms of use:

1. General Terms of Use

1.1 Eligibility

  1. The TQT Teacher Appreciation Programme is open to applicants of all races, nationalities, teaching subjects, or languages.
  2. Applicants must be current or retired Chinese independent school teachers or staff who have reached the age of 65 or older by January 1 of the issuance year.
  3. Applicants must be alive at the time an application is filled; the fund is not applicable by family members representing deceased individuals.
  4. Applicants must have been formally employed as teachers or staff by Chinese independent school, receiving a monthly salary and entitled to government-mandated benefits such as EPF and SOCSO. Part-time, temporary, advisory, directorial, outsourcing, and contractors are not considered (applicants must provide a Service Certificate issued by the school).
  5. Applicants must have accumulated over 25 years of service in any Chinese independent school nationwide (equivalent to 300 months) before January 1 of the issuance year. Continuous service within the same school is considered; any interruptions, including leaves without pay, should be deducted.
  6. Interruptions or transferring between Chinese independent schools within service period is allowed, but service years in “Sekolah Kebangsaan”, “Sekolah Jenis Kebangsaan (Cina)” or private school/college are not counted.
  7. The applicant’s information will be verified by the respective school, and only those approved by the organizer will be included in the list of recipients for the current year.
  8. For non-applicant or user of our TQT Website/Apps, you are NOT eligible to use the Service without consent if you are under 18 years of age or any other age, which the law does not allow you to enter into a legally binding contract in the jurisdiction you are from. If you are between the ages of 13 and 17, you can use the Services with the consent and supervision of your parent and/or legal guardian who is at least 18 years old, provided that your parent and/or legal guardian also agrees to be bound by these Terms and agrees to be responsible for your use of the Services.

1.2 Accessing Our Services

  1. We will use reasonable efforts to make our Services available to our Users without any interruption. However, as our Services are also dependent on other third-party service provider, we do not guarantee that our Services, will always be available or uninterrupted, especially when our third-party service provider is the cause of the interruption. As such, we will not be liable to you if for any reason our Services are unavailable at any given time. Unless specified or agreed otherwise, we also reserve the right to suspend, withdraw, discontinue, or change any part of our Services without prior notice.
  2. You are responsible for making all arrangements necessary for you to have access to our Services.
  3. You are also responsible for ensuring that all persons who access our Services through your internet connection or account are aware of these Terms and that they comply with them.
  4. You acknowledge that the features and functions of the Content and/or Services on the Website may differ from the Mobile Application.

1.3 Rules of Conduct

  1. TQT Website/Apps is not a place for hatred, abuse, discrimination, disrespect, profanity, meanness, harassment, or spam.
  2. DO NOT:
    • Use the Services to promote violence, degradation, subjugation, discrimination or hatred against individuals or groups based on race, ethnic origin, political opinion, religion, disability, gender, age, sexual orientation, or gender identity;
    • Post images or videos that are sexually explicit or post links to sites that contain sexually explicit material or show people or animals being hurt or degraded;
    • Engage in any activity that interferes with or disrupts the proper working of the Services or any activities conducted on the Services; or bypass any measures, MSEF may use to prevent or restrict access to the Service;
    • Run any form of “spam” on the Platform;
    • Use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Platform; or
    • Take any action that imposes, in MSEF’s sole discretion, an unreasonable load on our infrastructure;
    • Represent products created by others as your own creation, or act as a reseller of others’ products;
    • Sharing account in an unauthorized manner;

  3. TQT Website/Apps may not work on devices that MSEF detects or reasonably suspects to break any rules of conduct, and MSEF reserves the right terminate User Accounts for such activities. MSEF reserves the right to bar anyone, applicant, user from the use or access to this TQT Website/Apps at the sole discretion of the MSEF. Termination of access can be executed permanently or over a period of time, in part or in whole, depending on the MSEF’s discretion, at any time without any prior notice or reason.
  4. You agree that MSEF may employ any lawful mechanisms to detect and respond to any breaking in rules of conduct, including checking your device for the existence of exploits or hacking and/or unauthorized software.
  5. Registration:
    • In consideration of your use of the Services and Website/Apps, you agree to provide true, accurate, current and complete personal information as may be prompted by any registration form on the Platform (“Complete Registration Information”); and maintain and keep us updated in regard to the Complete Registration Information.
    • If you fail to provide Complete Registration Information, or we have reasonable grounds to suspect so, we reserve the right to suspend or terminate your account and refuse your current or future use of the Services and Website/Apps at all or in portion. Without contrary to the foregoing provision, we may provide you with access to some part of the Website/Apps and/or Services without you registering as a user.

1.4 Information and material in Platform

  1. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this TQT Website/Apps for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
  2. Your use of any information or materials on this TQT Website/Apps is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any Services or information available through this TQT Website/Apps meet your specific requirements.
  3. This TQT Website/Apps contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
  4. From time to time, this TQT Website/Apps may also include links to other resources and materials. These links are provided for your convenience to provide further information. They do not signify that we endorse them. We have no responsibility for the content of the Other Linked Platforms.

1.5 Intellectual Property

  1. This Website/Apps belongs to MSEF. The copyright to the contents of this Website/Apps is owned by or licensed to MSEF excluding those intellectual property rights of vendors or alliances who have authorized MSEF with the necessary usage and reproductions of the content of this Website/Apps. This Website/Apps is intended for personal use, quick reference, illustration and information purposes only and may not be copied, redistributed or published in any manner without the written permission of MSEF.
  2. Any unauthorised use of any part of this Website/Apps is strictly prohibited. You may not copy or transmit any of the content herein in whole or in part for commercial purposes without the express written permission of MSEF – which if granted, would only be extended to our own materials.
  3. The trademarks, logos, characters and Service marks (collectively “Trademarks”) displayed on this Website/Apps belongs to MSEF excluding those intellectual property rights of vendors or alliances who have authorized MSEF with the necessary usage and reproductions of the content of this Website/Apps. 2.6 MSEF shall not be liable for any damages (whether special, incidental, consequential, direct or indirect) loss of profits, injuries, savings or goodwill howsoever arising including but not limited to those resulting from your use or inability to use information provided from this TQT Website/Apps or for any damages or loss caused by any failure of performance, omission, inaccuracy, completeness, interruption, malfunction, delay in transmission, computer virus, unauthorized access to, and use of this Platform or due to any event beyond the MSEF’s control.

3. Accounts and Passwords

3.1 You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lowercase letters, numbers and symbols) with your account. You must treat such information as confidential. You must not disclose it to any third party. MSEF cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

4. Termination

4.1 The Terms will continue to apply until terminated by either you or us as follows:

  1. You may end your agreement with us at any time for any reason by deactivating your accounts and discontinuing your use of the Services.
  2. We may suspend or terminate your accounts or cease providing you with all or part of the Services at any time for any reason, including, but not limited to, if we reasonably believe:
    • you have violated these Terms; or
    • you create risk or possible legal exposure for us; or

4.2 In all such cases, any provision of these Terms that expressly or by implication is intended to come into or continue in force on or after termination of this agreement shall remain in full force and effect.

4.3 Nothing in this section shall affect our rights to change, limit or stop the provision of the Services without prior notice.

5. Indemnify

You shall indemnify and keep MSEF indemnified against all claims, damages, actions and proceedings made or brought against the MSEF arising from your use of this Website/Apps and/or any breach of terms in relation thereto by you.

6. Modifications of Terms and Conditions

We reserve the right to revise, change and modify this Terms and Conditions from time to time without prior notice. We highly recommend you check our website on an ongoing basis for the most updated version. If you object to any such changes, your sole recourse shall be to cease using the Website/Apps or Services. Continued use of the Website/Apps or Services following notice of any such changes shall indicate your acknowledgement of such changes and satisfaction with the Site or Services as so modified.
