Privacy Policy
Introduction
MSEF respects the privacy of individuals about personal data. This Privacy Notice formulated in accordance with the Personal Data Protection Act 2010 (“PDPA”).
Definitions
- The term ‘MSEF’ or ‘us’ or ‘we’ or ‘the foundation’ refers to MALAYSIAN SOCIAL ENTREPRENEURS FOUNDATION (Company No.: 1160621-T), a company incorporated in Malaysia.
- The term ‘Organization’ refers to any not-for-profit organization, or non-governmental organization who has registered with thankyouteacher.my(TQT) Platform to use its Services.
- The term ‘you’ refers to yourself and such other persons or organizations represented by you of which you are providing the Personal Data.
- The term ‘Personal Data’ or ‘personal data’ means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organization has or is likely to have access.
- The term ‘thankyouteacher.my Platform’ or ‘Platform’ refers to this web that owns by MSEF.
- The term ‘Other Platform’ refers to other web that not owns by MSEF.
1. Information Collected
1.1 Registration
- Such personal data for person may include (but not limited to) name as per NRIC card, preferred name, NRIC number, email address, contact number, residential address, email address, gender, race, nationality, occupation, designation, skill category, information of emergency contact such as name, relationship, and contact number, information of your company such as name, registration number and address, information as to physical or mental health, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of an offence and such other data necessary for the purposes which the personal data is collected.
- Such personal data for organization may include (but not limited to) organization name as per registered at Malaysia registration authority, registration number, email address, contact number, information as to organization introduction, categories, resident list, utility bills, site photos and other related information, information of founder, chairman, and manager background such as name, occupation, designation, and NRIC number.
1.2 The Personal Data about you which we may collect via print and digital channels (including but not limited to Platform and Social Media) includes:
- Information collected when you register or update an online profile or when you fill in or update your information with us, which may include personal data such as your photograph, name, and contact details;
- The contents of all printed and electronic forms or documents submitted to us via printed collateral or forms, the Platform and any digital and mobile Platforms (e.g., Email, Facebook, Twitter, Instagram, WhatsApp, and any social media), including identity documents and proof of address;
- Information input or submitted to online facilities such as search tools;
- Language preferences you select as you use the Platform;
- Information submitted if you participate in the Services or Platform whether via online or otherwise;
- Any messages you submit to us via the Platform or in whatever manner, which may include personal data such as name, email address and contact number;
- Information obtained independently by MSEF from other lawful sources;
- The contents of all forms and/or documents submitted by Organization and/or collected by MSEF.
1.3 The personal data provided by you to MSEF may, if required, be disclosed to the following classes of third parties:
- MSEF’s sub-contractors or third-party service or product providers as may be determined by MSEF to be necessary or appropriate;
- government agencies and selected parties within or outside Malaysia including strategic partners that work with MSEF in connection with MSEF’s business activities or any event or programme;
- agents, contractors, auditors, consultants, accountants, insurers, lawyers or other financial or professional advisers of MSEF;
- regulatory bodies, government bodies or other authorities if required or authorized to do so to discharge any regulatory function under any law or in relation to any order or judgment of a court;
- any person to whom MSEF is compelled or required to do so under the law;
2. Purpose of Collection of Personal Data
2.1 By providing any of your Personal Data, whether via online or otherwise, you hereby agree that we shall collect, retain, and use the Personal Data for the following purposes:
- Register you as a user on the Platform;
- Provide services to you through the Platform;
- Conduct the matching procedure to match Volunteer and Organization to the specific skills you need/have;
- Communicate with you and respond your enquiries;
- Provide you with information regarding the Platform, administrative information, the activities, products, services, events and programmes that may be organized, managed, facilitated, provided, sponsored and/or participated by MSEF or offered by selected third parties that may interest you;
- Comply with any legal or regulatory requirements applicable to MSEF, and to make disclosure under the requirements of any law, regulation, direction, court order, by-law, guideline, circular or code applicable to MSEF;
- Seek your voluntary feedback;
- For MSEF’s internal record keeping;
- Customize features or content on our tools or Services;
- To conduct research, study, assessment, survey and/or prepare reports/statistics analysis for purpose and objectives of Platform and Platform’s activities;
- Purposes connected with the enforcement of our rights pursuant to any letter, agreement and/or document including seeking legal advice, taking any preliminary steps or commencing any legal action;
2.2 We may either contact you for the purpose as set out in (2.1) above via telephone calls, emails, short message services, social media or by whatsoever form of available communication.
2.3 Please note that in the event that sufficient Personal Data (‘Complete Registration Information’) is not supplied, or is not satisfactory to MSEF then your application or request to MSEF for any of the above purposes as set out in (2.1) above may not be accepted or acted upon or your request to browse some information on the Platform may be denied or we will not be able to provide the full range of benefits and/or services and/or perform its obligations under any potential or existing contract with you.
3. When we disclose your personal data
3.1 Where required by law, where we consider that such use or disclosure is necessary to respond to any claims or legal process, or where we suspect that fraud or unlawful activity has been, is being or may be engaged in; and/or
3.2 Making such disclosures as may be required for any of the above purposes as set out in (2.1) above or by law.
3.3 MSEF uses and discloses aggregated non-personally identifying information collected by us as part of the MSEF’s process of constantly improving the Platform and Platform’s Services.
4. Storage and retention of the personal data
4.1 Your Personal Data shall be stored either in hard copies in our offices or stored in servers located in or outside Malaysia and operated in or outside Malaysia.
4.2 Any Personal Data supplied by you will be retained by us as long as necessary for the fulfilment of the purposes stated in (2.1) above or is required to satisfy any legal, regulatory and/or accounting requirements or to protect our interests.
4.3 The Platform does not offer any online facilities for you to delete your Personal Data held by it.
5. Safety and confidentially of your Personal Data
5.1 MSEF has implemented security policies and technical measures to protect your personal data in accordance with such requirements of the applicable personal data protection laws and regulations. Where we consider it necessary or appropriate for the purpose of data storage or processing, we may transfer the personal data to a third-party service or product providers within or outside Malaysia, under similar level of security measures.
5.2 Personal Data held by the Platform will be kept confidential in accordance with this Privacy Notice pursuant to any applicable law that may from time to time be in force.
5.3 Any questions, comments, reviews, suggestions or information other than Personal Data submitted to us in whatever manner (including those sent or posted in the Platform) will be deemed voluntarily provided to us on a non-confidential and non-proprietary basis.
5.4 The Platform reserves the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely as set out in (1.3) above.
6. Right of Access to Personal Data
6.1 Under the Act, you have the right of access to your Personal Data held by the Platform and you may request that the Platform correct any of your Personal Data that is inaccurate, incomplete or out-of-date, subject to any applicable legal restrictions and contractual conditions.
6.2 If you have any questions regarding this Privacy Policy or if you wish to request access to your Personal Data or if you wish to correct your Personal Data or if you wish to delete your Personal data from the Platform or if you wish to withdraw your consent to the Platform for the processing of your Personal Data for the purposes as set out in (2.1) you may send your request in writing. Please refer to (10).
7. Links
The Platform may contain links to Other Platform and pages. By activating a link, such as for example by clicking on the link to any social media, you leave the Platform and it does not exercise control over any Personal Data or any other information you give to any other entity after you have left the Platform.
8. Cookies
This thankyouteacher.my Platform uses cookies to monitor browsing preferences. If you do allow cookies to be used, the following personal information may be stored by us for use by third parties.
If you do not wish to receive cookies, please configure your Internet browser to erase all cookies from your computer’s hard drive, block all cookies or to receive a warning before a cookie is stored.
9. Modifications of Privacy Policy
We reserve the right to revise, change and modify this Privacy Policy from time to time without prior notice. We highly recommend you check our website on an ongoing basis for the most updated version. If you object to any such changes, your sole recourse shall be to cease using the Platform or Services. Continued use of the Platform or Services following notice of any such changes shall indicate your acknowledgement of such changes and satisfaction with the Platform or Services as so modified.
